Description (Service) Notary Public  
A notary public is a person who has the power to witness oaths, solemn affirmations, the signing of affidavits or statutory declarations. A notary public may also certify documents to be true. In Ontario, notaries derive their power from the following provision of the Notaries Act: "notary public has and may use and exercise the power of drawing, passing, keeping and issuing all deeds and contracts, charter-parties and other mercantile transactions in Ontario, and also of attesting all commercial instruments that may be brought before him or her for public protestation, and otherwise of acting as is usual in the office of notary public". The Government of Ontario maintains records and a list of all individuals who are authorized as notaries public. 
 
Notaries can be found by using the yellow pages in the phone book or an internet search. Most lawyers are also notaries.  
 
Commissioner of Oaths  
A Commissioner of Oath is a person authorized to take your oath or solemn affirmation when you sign an affidavit or a statutory declaration. A Commissoner does not certify that the statements being made in the affidavit or statutory declaration are true, but only certifies that an oath or solemn affirmation has been administered properly.  
 
Commissioners of Oaths are: Regional Clerk or Deputy Regional Clerk;  
City Clerk or Deputy Clerk; Treasurers or Deputy Treasurers of municipalities; Justices of the Peace (for items of a legal nature); Lawyers; Licensed Paralegals; Police Chiefs; some staff at the Service Ontario, Government Information Centre are Commissioners.  
 
Justice of the Peace will only sign documents dealing with the court system.
